Permanent Residency in Canada

Canadian Immigration used to receive many more applications than could be processed in a timely way. As a result, the department limited the number of new applications it would consider in the federal skilled worker category every year and introduced the below 2 main pathways to be considered for Canadian Skilled Migration:

  • 1. Express Entry
  • 2. Provincial Nomination (PNP)

Express Entry :

Express Entry is designed to facilitate the immigration of skilled workers to Canada "who are most likely to succeed economically." The system boasts efficient processing times, with 80% of applications processed in 6 months or less.

Those who are eligible for one of the programs managed by Express Entry submit an Express Entry Profile and the Canadian government issues the successful candidates an Invitation to Apply (ITA) on which the candidates can submit an application for permanent residence. A positive result on this application will grant the applicant, and their accompanying family members, Canadian permanent resident status.

Approximately every two weeks (this trend has been affected by Covid-19 Pandemic), the Canadian government conducts an Express Entry draw, inviting the most competitive Express Entry candidates to apply for Canadian permanent resident status. In these draws, the federal government establishes a cut-off score, using the Comprehensive Ranking System All candidates with scores higher than the cut-off will receive an official Invitation to Apply (ITA) for permanent residency.

How Express Entry works

In order to apply under express entry, the candidate is supposed to assess himself against the eligibility criteria through the online Express Entry tool available on Canadian Immigration website. The candidates are welcomed to consult our team for advice should they not be able to make this assessment on their own. If the assessment criteria establish positive indications for the candidate in meeting the points pass mark, the candidate can proceed with the following steps:

Step 1

Get your documents ready

You need documents, such as language test results and Educational Credentials, to show that you’re eligible for Express Entry. Some documents take a long time to get, so you should get them ready now.

Step 2

Submit your profile

Your Express Entry profile is where you give information about yourself to Canadian Immigration Authority. If you’re eligible, they’ll accept you into their pool of candidates. You’ll be ranked in the Express Entry pool using a points-based system. Your score is based on the information in your profile.

Step 3

Apply for permanent residence

Canadian Immigration Authority sends invitations to apply to the candidates with the highest scores in the pool. If they invite you to apply, you’ll have 60 days to submit your application for permanent residence.

Most complete applications that have all the supporting documents are processed in 6 months or less.

Provincial Nomination (PNP)

The Manitoba Provincial Nomination Program is an immigration program operated by the Canadian province of Manitoba. The program allows Manitoba to nominate qualified applicants for Canadian permanent resident status. The program is divided into 4 streams for different types of candidates:

The PNP pathway makes it easier and faster for an eligible applicant to arrive in Canada as a skilled worker but such immigrant is supposed to contribute back to the nominating province by living there, working there and establishing his occupation, income as well as family there. However, such contribution is expected for a limited number of years (2 years in most provinces) and after this the immigrant may choose between remaining in the province or moving elsewhere.

The process of obtaining PNP Immigration works more or less like Express Entry except for the fact that there is an additional step of PNP process which (in most cases) comes after submission of and Express Entry application until the receipt of the Invitation to Apply. It is the PNP grant that adds more points OR puts the applicant’s application in a preference category after it has been in the Express Entry Pool for a while and it is the same PNP grant that puts the applicant above other applicants (who do not have PNP) and must wait further for their invitation to apply.

Therefore, the PNP is rightly considered to be something giving a fine edge over competing applicants in the Express Entry pool and those successful applicants who get the PNP have a smoother pathway to Canadian Immigration than others. However, the factors involved in the PNP Nomination criteria are neither simple nor in everyone’s easy access therefore the applicant must closely look at PNP requirements for their desired province before establishing any hopes with the program. For example, most provinces (e.g. Manitoba, British Columbia, Nova Scotia) allow PNP only if the applicant has a close relative living in that province, a job offer from that province or prior education or work completed in that province. Others, such as Ontario and Saskatchewan have been observed to be considering applicants without above factors but definitely with high score on Express Entry. Hence, the complete and comprehensive understanding and continuous follow up of the updates of the Provincial Nomination Program of each state is very essential towards finding someone’s opportunity in this program.
