SCHENGEN BUSINESS VISA REFUSAL / APPEAL

(Spain, Germany, Italy, Netherlands, France, Poland, Czech Republic, Hungary)

Business Visitor Visas for Schengen countries are filed for the purposes like (i) Business Meeting, (ii) Business Survey/Inspection, (iii) Conference/Exhibition/Trade Fair, or (iv) Research. While these applications have a targeted point to be assessed (i.e. need, importance, reliability and genuineness of the purpose of visit), these applications are also processed under the Schengen Borders Code, which processes other visas. Hence, there is always a likely chance of a business visitor visa application to be refused under one of the following clauses:

2. Justification of the purpose of visit and conditions of the intended stay was not provided

6. One or more Member State(s) consider you a threat to public policy, internal security, public health, as defined in article 21(9) of Regulation EC No 562/2006 Schengen Borders Code or international relations of one of more of the Member State(s)

8. The information submitted regarding the justification for the purpose and conditions of the intended stay were not reliable

The applicant must understand that before being very important, regular, experienced or senior visitor, he has to be a genuine visitor otherwise his company name, his travel history, his financial ability or his family status – nothing will be recognized and he will be refused a visa. The applicant’s need, suitability and genuineness must be proven in the current application through his documents and information and only then he may be granted a visa. Relying on past travel history, past financial ability or previous purposes of visit might therefore not work if in the current application these factors are not satisfied. A genuine and complete application only can have chances of visa grant therefore whatever is required to be proven in an application must be proven in it through documents. Visitor for business meetings must therefore not just prove connection with the European counterpart (through an invitation letter) but must also prove that he really is in the same line of business/activity as his host in the country of visit and therefore he is a relevant person to organize this visit. Likewise, the meeting purpose should also be well explained and proven through documents otherwise the visa officer might not be satisfied. This means that you may have a business connection in the Schengen country but what is so important in this connection at present time that cannot be fulfilled/achieved without a physical visit. Most of the business visit visa applicants that are seen to have been refused lack in the business documentation from their home country. They do always have a business letterhead requesting for grant of visa and some business certificates (such as from Chamber of Commerce and Industry) but they lack in establishing their status as the managerially or technically being suitable for this visit. They also fail to define what growth, new business, solutions would the proposed visit would bring to their business/work in the home country and hence the importance of purpose of visit is not established.

Conferences/Exhibitions/Trade Fairs visitors also merely rely on Exhibition Tickets to prove their purpose of visit while the visa officer wishes to see something beyond this. Again, the relevance of the personal background of the applicant is put against the purpose of visit and only after complete satisfaction between these two, the applicants purpose of visit is given some recognition;
