Replacement of UK Sole Representative Visa :
The latest Statement of Changes to the Immigration Rules has been published by the UK Govt. This statement contains several modifications, and immigration routes, mainly for Sole representative visa applicants. The Representative of an Overseas Business route will be replaced by the UK Expansion Worker route under Global Business Mobility. It is a route for specialist employees and senior managers that are employed in international businesses that are expanding into the UK.
Other investment visa categories are also affected as a new classification is introduced by the UK government. A new category called Global Business Mobility will replace four of the existing routes for immigration and will introduce a newer route in their place. The Intra-Company Transfer route is replaced by the Specialist or Senior Worker route. It will be most useful for the employers who transfer employees from international group entries to the UK. The Specialist or Senior Worker route has largely the same requirements as the Intra-Company transfer route, differing only in the minimum salary threshold, which is £42,400 in the latest statement.
For the employees who will be seconded to the UK as a part of an investment or a high-value contract, the Secondment Worker route will be the most suitable, which has been introduced in the recent modification of the law.
However, regarding the Skilled Worker route, which is the most highly used route for immigration to the UK, no certain changes have been made as of now. In addition, the details of the Scale-up and High Potential Individual routes have been finalized. High Potential Individuals need to have attended a “top global university” to get a visa. For the Scale-up visa, the businesses which have at least 20% turnover may fill their skilled positions from overseas.
For international students who switch to the Graduate Visa while residing in the UK, they can begin working in a full-time position. They can start their work once they have applied without needing to wait for their application to be answered, as long as their studies have been completed.
Some minor amendments have been made to the Global Talent route. Applicants of the Global Talent route must be at an early stage in their career. For the Seasonal Worker on the route, a new minimum salary of £10.10 has been applied.
These laws have been presented by the Home Office in order to make the existing immigration rules simpler and to provide clarity to employees and businesses. These changes in the new Statement of Changes to the Immigration Rules are to be implemented in April 2022, from the 11th of April to the 22nd of the month. The new statement in which the government announced bespoke immigration rules would ultimately contribute to the economy of the UK.
